One of the biggest long term exposures a developer has on a project are accessibility issues due to Federal Fair Housing Act (FHA) enforcement by the United States Department of Justice (DOJ). The exposure to accessibility litigation has no statute of repose/statutes of limitation nor can the exposure be transferred in a sale. IPS provides risk mitigation services including: Federal Fair Housing Act (FHA) plan reviews, American’s with Disabilities Act (ADA) reviews, as well as jurisdictional requirement reviews that minimize the risks associated with non-conformance. We also provide observation services during construction to ensure the project is meeting compliance and provide documentation that demonstrates such. This documentation is also used upon disposition of the asset minimizing exposure to price reductions associated with non-compliance. Our experience in this area minimizes exposure from litigation, minimizes change orders and delays from non-compliant plans or construction and provides the developer peace of mind knowing the exposure has been mitigated.
CONSTRUCTABILITY AND COORDINATION REVIEWS
IPS provides constructability & coordination reviews which are a crucial opportunity to mitigate exposure to change orders, litigation and schedule impacts that decrease profitability. IPS applies its 30+ years of experience to deliver a written report & redlines to the design team identifying areas of improvement prior to releasing to the GC. This process minimizes change orders and schedule impacts while the project is being constructed and thereby increases profitability and investor satisfaction.
Our cost & schedule management processes actively control all project phases, giving project participants a clear picture thru the process allowing team members to make timely, informed decisions. In addition, integrating cost and schedule data from each project identifies potential interference's with, impacts to, or competition for limited resources, often before program/project milestones are impacted.
IPS provides construction observations services where we execute the risk mitigation plan established in the previous phases. IPS reviews required submittals and provides appropriate responses, reviews schedule presented by GC and provides construction observation at regular intervals during construction to ensure compliance with the plans and building standards. Once construction is completed IPS will request the required closeout documents and conduct a thorough review when provided. Upon acceptance of the close out documents IPS provides approval for the release of the final payment.
